Acceptance of These Terms

Welcome to CPSTester.io. These Terms of Service ("Terms") govern your use of the CPSTester.io website and every tool on it, including the CPS Test, Kohi Click Test, Jitter Click Test, Mouse Test, Polling Rate Test and Scroll Test (together, the "Service").

By using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

In these Terms, "we", "us" and "our" mean CPSTester.io. "You" means anyone who visits or uses the Service.

Who Can Use CPSTester.io

You may use the Service if you are at least 13 years old. If you are under the age of majority where you live (usually 18), you may use the Service only with the permission of a parent or legal guardian, who agrees to these Terms on your behalf.

You may not use the Service if the law where you live doesn't allow it.

Our Tools and Your Results

CPSTester.io is a free set of browser-based tools that measure click speed, clicking consistency and mouse performance. You don't need an account to use it.

Your results depend on many things we don't control, including:

  • your browser and operating system
  • your device and mouse hardware
  • your internet connection
  • other apps or tabs running at the same time

Some browsers limit how often a webpage can read mouse input, which can affect readings such as polling rate. For these reasons, all results are estimates for practice, entertainment and general information only.

Our tools are not professional hardware diagnostics. A result that suggests a faulty button, switch or scroll wheel is not a guarantee of a fault. Please don't rely on it alone for warranty claims, repairs or purchases. Check with your device's manufacturer.

We may add, change or remove tools or features at any time.

Acceptable Use

When using the Service, you agree not to:

  • Interfere with the Service: for example, overloading our servers, introducing viruses or malicious code, or trying to get around our security.
  • Scrape or copy at scale: use bots, crawlers or scrapers to copy our content, tools or data, except search engines that follow our robots.txt file.
  • Commit advertising fraud: click ads, or cause ads to be clicked or viewed, through bots, autoclickers, scripts or any other artificial means, or encourage others to do so.
  • Misrepresent results: use autoclickers, macros or scripts to produce test results, and then present those results as genuine human scores.
  • Break the law: use the Service for anything illegal, harmful or that violates someone else's rights.
  • Pass off the Service as your own: frame, copy or rebrand CPSTester.io, or embed our tools on another website without our written permission.

We may block access for anyone who breaks these rules.

Intellectual Property

The Service and everything on it belong to us or our licensors and are protected by copyright, trademark and other laws. This includes:

  • the design, code and tools
  • the text, guides and graphics
  • the CPSTester.io name and logo

We give you a personal, non-exclusive, non-transferable right to use the Service for your own non-commercial purposes. You're welcome to share screenshots of your own results or link to our pages. You may not copy, modify, sell or republish any part of the Service without our written permission.

Game names and trademarks mentioned on the site, such as Minecraft and Roblox, belong to their respective owners. Mentioning them doesn't mean those owners endorse us or that we're affiliated with them.

Advertising and Third-Party Links

The Service is supported by advertising, including ads served by Google AdSense and its partners. We don't control the content of these ads and don't endorse the products or services advertised.

The Service may also contain links to third-party websites. We aren't responsible for their content, policies or practices. Your use of any third-party website is at your own risk and governed by that site's own terms.

Privacy

Our Privacy Policy explains what information we collect, how cookies, Google Analytics and Google AdSense are used, and the privacy rights you have. It forms part of these Terms.

Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, either express or implied. This includes, without limitation, warranties of accuracy, reliability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

We don't guarantee that:

  • the Service will always be available
  • results will be accurate or consistent across devices
  • the Service will be free of errors, viruses or other harmful components

Nothing in these Terms limits any rights you have as a consumer that cannot be excluded or limited under the law where you live.

Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of, or inability to use, the Service.

The Service is free. To the fullest extent permitted by law, our total liability for any claim relating to the Service is limited to US$50.

Some jurisdictions don't allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded by law.

You agree to indemnify us against any claims, losses or costs that arise from your breach of these Terms or misuse of the Service.

Changes, Suspension and Termination

We may update these Terms from time to time. The "Last updated" date at the top shows the current version. If we make significant changes, we'll show a notice on the site. Continuing to use the Service after changes take effect means you accept the updated Terms.

We may suspend or end your access to the Service at any time, without notice, if you break these Terms or if we need to protect the Service or other users. We may also discontinue the Service, in whole or in part, at any time.
